Terms and conditions

Condition of Entry

• Visitors enter Ōamaru Penguins as a condition of acceptance and complies in full of these Terms and we reserve the right to refuse entry to any person or to remove a No liability for loss, injury or damage will be accepted.

• To be permitted entry to the penguin colony you must have a valid ticket dated for that day (either in physical or electronic form)

• If a ticket is being used in a fraudulent manner, has been altered or defaced we may refuse to honour

• Day tours require a ticket and is self-guided, however we do have a guide on hand to answer your questions. Photography and filming without flash is allowed in the colony during the day, but not in the viewing room.

• Evening viewing requires a ticket for access; purchases can be completed online or at the shop. Photography or Filming is not permitted during evening viewing

• All ticket prices are in New Zealand dollars and include GST.

• Daytime access to around the harbourside to view the seals is free until gates close prior to evening viewing times.

• Visitors must not enter any habitat, cross any barrier, or enter any area marked 'no entry' or 'staff only', unless accompanied by a staff member.

• Children must be always supervised by a responsible adult aged 15 years or over. Ōamaru Penguins reserves the right to report any unaccompanied children to the appropriate authorities.

• Where reasonably necessary for operational, safety or security reasons, we reserve the right to cancel or suspend access to the facility including without limitation because of a Force Majeure Event.

• Dress appropriately for the conditions, even in the summer it is wise to wear layers for warmth in the evenings.



Refunds

• To be eligible for a refund on a pre-purchased ticket, notification must be made 24 hours prior to the tour departure. However, if something unforeseen occurs on the day you are due to arrive, please contact us and refund terms will be at the manager's discretion.

• We do not offer refunds to those who pay in advance for tickets and fail to show up for tours.

• A refund will be given in the same way it was paid for.

• Refunds will be given in NZD, and OBPC is not liable for any loss incurred in movements in the exchange rate between the time of purchase and the time of refund.


Ticket prices

All ticket prices are in New Zealand dollars and include GST


Late Arrivals / Early Departures

• It is encouraged to arrive at a reasonable time before the scheduled start time doors open approximately 30 minutes before the start time.

• General entry seating for late arrivals- guides will direct you to seating areas to reduce disruptions to others.

• Early exiting from general entry seating will be done via the stairs located at the back of the stand.


Lost, stolen or damaged property and vehicles

• Ōamaru Penguins do not take any responsibility for any personal items left behind and cannot guarantee that it will be possible to identify or contact the owner. We will keep lost or left behind items for 6 months, if not claimed we will donate to a worthy cause.

• Parking in the car park is free and available for visitors. We recommend that any items of value are stored in a secure place in the vehicle.


Parking

Visitors must comply with the car parking signs displayed in the car parking area. Ōamaru Penguins accepts no liability for any claim by you or any other person, whether for loss or damage to your vehicle or any other vehicle, whether resulting from using the car park or from your own negligence or otherwise.

• Parking in the carpark next to the Ōamaru Penguins is at your own risk. Please park responsibly.

• You must not obstruct other vehicles in the carpark. There are parks marked for campervans and private vehicles. Buses park in any area marked “Bus Parking”. Do not block areas identified as “No Parking”, or in zones identified with NP. You must not park on the road edge in and around the carpark and Waterfront Road. Any car parked in a mobility bay must display a current mobility pass.

• Parking is available for visitors free of charge


Photography and Filming

• Photography and Filming is not permitted during evening viewing

• Photography and filming without flash is allowed in the colony during the day, but not in the viewing room.

• Do not use or operate any drone or similar aircraft while in the Colony

• Use any large or professional video or photography equipment (including tripods or freestanding lighting equipment) without our prior written approval.


Use of image

Consent to and authorise any filming, recording or photography of yourself to use in commercial marketing and promotional exhibitions, publications and social media for purposes to promote Ōamaru Penguins.


Marketing

You acknowledge that by purchasing a ticket, you agree to receive marketing communications from us. You can opt out at any time by notification directly to us.


Your acknowledgements

You acknowledge and agree

1. All smoking, vaping and e-cigarettes are strictly prohibited throughout the Colony. Visitors who do not comply will be asked to leave or may be removed.

2. Visitors must not bring in any animal except for guide and assistance dogs required for medical reasons as documented in a medical certificate. Do not leave dogs in cars.

3. Any personal items that fall inside the fenced area, please notify a member of staff immediately.

4. We may decline to allow you or any person with you that is deemed to be under the influence of alcohol or drugs will be asked to leave. We can reissue you a ticket for the following evening.

5. If you or any person with you are engaged in any anti-social behaviour which is threatening and intimidating to other persons including staff and other visitors which can not be resolved, you will be asked to leave the premises.

6. To not touch, take any cutting or otherwise interfere with any plant, nest or habitat;

7. To act unsafely towards yourself or others

8. To take away up any litter or rubbish your brought in with you. Or deposit into the designated rubbish bins on your way out.
